SUMMARY
the schematics of the Framework Agreement on First Nations Land Management are a developmental procedure. This page will outline that process and how the different component areas work in a systematic way to achieve an end result. All we have to do here in Swan Lake is follow that procedure and one thing naturally leads to another in logical sequence.

 

 

 
BILL C 49
is federal legislation that empowers the first nations who endorse it to transfer their reserve lands from the authority of the Indian Act. To empower Bill C-49 legislation upon Indian Reserve Lands, the people of the band must ratify this legislation. The powers of Bill C-49 shall remain supreme to any land code devised by any First Nation.

 
LAND CODE
is a procedure that ratifies Bill C-49 and empowers it upon Indian Reserve Lands by its ratification. The Land Code is not the legislation in itself but a by-product that gives notice to the federal government that the band is endorsing Bill C-49 powers to be applied. The Land Code is a management system that applies to certain land matters and allows a consultation process with other levels of government.

 

 

 
RATIFICATION is a process that collects all members of a band that are of voting age to vote on the land code. The Ratification process is a public procedure that legitimizes the Framework within a framework of transparency.
INDIVIDUAL AGREEMENT
is an arrangement with the federal government that has an active duration of 5 years. This arrangement must be established and negotiated by designated authorities representing the federal government and the first nation. It outlines the fiscal relationship between the entities and applies to the carrying out of and maintenance of the responsibilities outlined within the land code.
